Referral Terms
1. Clim8 Invest Ltd (“Clim8”, “we”, “us”) delivers via an app investment services that are designed to make an impact on Climate change. When you, one of our customers, invite your friends to join Clim8 (such invited friends being “Referrals” and each a “Referral”) using the process set out below, we will donate £40 (£20 for you and £20 for your Referral) to the one of the charities we support as disclosed separately to you (the “Charity”) (all together, a “Donation”).
2. This promotion is available from 23:59 UK time on 24 March 2022 until the date on which we end this promotion (the “Offer Period”). We may end this promotion by giving one month’s notice via our website, and this will not impact our obligations in relation to providing any Donation for any Referrals made before the date on which this promotion ends. It is your responsibility to monitor our website to ensure that this promotion still applies when making any Referral. This promotion is limited to the first 10 Referrals you make within the Offer Period, and we will pay one Donation per Referral.
3. The Donation will be paid within 30 days of the requirements set out in clauses 4 and 5 below being satisfied. Please note that any Donation cannot be redeemed for cash and is non-transferrable.
4. In order for us to make a Donation, you need to:
a. yourself be a fully onboarded customer of Clim8 before making the Referral;
b. have yourself accepted our Terms (available at https://clim8.com/terms-and-conditions); and
c. click the “Refer a Friend” button on the Clim8 app, and select which Charity you wish us to make a Donation to.
d. have your Referral(s) sign up to use our investment services during the Offer Period using your unique referral link generated by clicking the “Refer a Friend” button; and
e. ensure that you continue to be an invested Clim8 customer for a month after your Referral makes his / her first investment with us.
5. This promotion is only available in relation to Referrals who:
a. are over the age of 18 and resident in the UK or the Channel Islands;
b. are eligible to open a Clim8 account with us and to use our investment services;
c. are not existing customers of Clim8, are not persons who have been a customer of Clim8 in the past, and are not an employees of Clim8;
d. become a Clim8 customer during the Offer Period, including accepting and complying with our Terms (available at [https://clim8.com/terms-and-conditions]); and
e. add at least £10 to their Clim8 account and leave it invested with us for at least 1 month.
6. We may suspend or change these Charity Donation Terms by giving you one week’s notice via our website. This will not impact our obligations in relation to providing any Donation for any Referrals made before the suspension or change.
7. Personal data supplied during the course of this promotion will be processed in accordance with our privacy policy: https://clim8.com/privacy-policy. Please note that:
a. We will let Referrals know your first name, if they ask for this information, and by making a Referral you consent to us communicating your first name to your Referral when they click on the referral link; and
b. By clicking on the link, the Referral consents to us communicating to you the Referral’s first name once the Referral has successfully on-boarded,
and this information may be shared for these purposes by email and in the Clim8 app. If either you or the Referral object this, then you / the Referral should not participate.
8. We do not accept any responsibility or liability for:
a. any Referral which does not comply with these Charity Donation Terms;
b. any Referrals which are not successfully completed within the Offer Period for any reason; or c. any loss which is not caused by our gross negligence,
except that nothing shall limit or exclude our liability for fraud, fraudulent misrepresentation, death or personal injury, or any other liability to the extent that it may not be limited or excluded by applicable law.
10. We reserve the right to disqualify any Donation in relation to a Referral where it cannot be verified that the Referral is made in accordance with these Charity Donation Terms. Our decision regarding any aspect of these Charity Donation Terms is final and binding.
11. If any part of these Charity Donation Terms is found by a court or body or authority of competent jurisdiction to be illegal, unlawful, void and / or unenforceable, such term will be deemed to be severed from these Charity Donation Terms and this will not affect the remainder of these Charity Donation Terms which will continue in full force and effect.
12. By making a Referral you agree and accept these Charity Donation Terms which constitute the entire agreement between us in relation to its subject matter. These Charity Donation Terms shall be governed by and construed in accordance with the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction in relation to these Charity Donation Terms and their subject matter.
13. These Charity Donation Terms do not create and shall not be construed as creating any partnership, joint venture, employer-employee relationship, franchisor-franchisee relationship and / or agency relationship between us.
